Environmental protection law 2018 new policy trend

        The "severe winter" of environmental protection in 2017 has given many enterprises a deep understanding of environmental protection. However, environmental protection governance will only be stricter in 2018, because there are many trends in environmental protection under the new policies in 2018. The most important one is that many environmental protection plans of the Ministry of environmental protection will be officially implemented in 2018. Are our enterprises ready?

Many enterprises have already taken it. How long will it take to check the environmental protection? Strict, definitely strict, will be more and more strict. What should our enterprises do? First of all, they should complete the transformation, have complete certificates and meet the environmental protection standards. They will not strictly investigate the enterprises, but even support them to become local models and leading enterprises. Secondly, small enterprises that are currently unable to do so will be affected for a long time. If you want to stay in business, you can only avoid the strict investigation area and move westward. Or have funds to build factories overseas.

   II. Several important legal documents on the new policy trend of the environmental protection law 2018 have come into force

   l environmental protection tax law of the people's Republic of China

   the environmental protection tax law of the people's Republic of China will be implemented on January 1, 2018. This is the first separate tax law in China that specifically reflects the "green tax system" and promotes the construction of ecological civilization. At present, all localities have basically defined the applicable tax standards for environmental protection tax and made preparations for the collection. The environmental protection tax adopts a fixed tax rate, that is, more discharge and more payment, less discharge and less payment. The difference in environmental tax burden will eventually lead to differences in product prices and production scale, forcing enterprises to transform and upgrade. After the Levy of environmental protection tax, enterprises that discharge air and sewage are most affected. According to the requirements of the environmental protection tax law, the tax range of taxable air pollutants is 1.2 to 12 yuan per pollution equivalent, and the tax range of water pollutants is 1.4 to 14 yuan per pollution equivalent.

   l reform plan for compensation system for ecological environment damage

   according to the reform plan, the ecological environment damage compensation system will be tried out nationwide from January 1, 2018. Ecological environment damage is often long-term and latent. In particular, it is easy to pollute and difficult to repair. Once a lot of pollution is caused, no amount of money can be fined to completely repair it. In view of this, the eco-environmental damage compensation system has become an effective measure. The purpose of trying out the eco-environmental damage compensation system throughout the country is to realize the need of bearing responsibility for damage.

   L water pollution prevention and control law

   on January 1st, 2018, the newly revised water pollution prevention and control law will also be formally implemented. Compared with the past, the water pollution prevention and control law defines many specific work requirements. For example, it requires that underground oil tanks in gas stations should use double-layer tanks or take other effective measures such as building anti-seepage pools, and conduct anti-seepage monitoring to prevent groundwater pollution; In addition, the new law on the prevention and control of water pollution has also increased the punishment for illegal acts in the water environment. On the basis of increasing the daily continuous punishment, the range of fines has been increased. For example, the fines for enterprises exceeding the standard and the total amount have been changed from "two to five times the amount of sewage charges" to "100000 yuan to onemillion yuan".

   l measures for the administration of pollutant discharge permit (Trial)

   the Ministry of environmental protection adopted the measures for the administration of pollutant discharge permits (Trial) on November 6, 2017. As a basic document to promote the implementation of the pollutant discharge permit system, the measures are very important. It is necessary to conduct in-depth study, careful consideration and careful treatment of various regulations, and accelerate their promulgation and implementation. The implementation of the pollutant discharge permit system is of great significance to the realization of the comprehensive discharge of industrial pollution sources and the implementation of the air quality improvement goals in key areas. It is necessary to serve the work of the center well, further strengthen the inspection and punishment of unlicensed sewage discharge and sewage discharge not in accordance with the license, and intensify the cleaning up and rectification of illegal projects, so as to provide strong support for the completion of the central task.

  six "supervision bureaus" of the Ministry of environmental protection officially unveiled

   III. Environmental Protection Supervision Bureau on the new policy trend of environmental protection law 2018

  the Environmental Protection Supervision Bureau has been upgraded from the original six regional environmental protection supervision centers of the Ministry of environmental protection. With the approval of the central editorial office, the environmental protection supervision center of the Ministry of environmental protection in North China, East China, South China, northwest, southwest and Northeast China has been transformed from a public institution to an administrative agency dispatched by the Ministry of environmental protection, officially renamed as the "Supervision Bureau". A major new function of the "Supervision Bureau" is to undertake the relevant work of the central environmental protection supervision and further strengthen the supervision of government. This also means that the central environmental protection supervision will become the norm.

  since the "three campaigns" of environmental protection were launched, coupled with the normalization of the central environmental protection inspection. Therefore, in the future, environmental protection legislation will be a general trend. From the perspective of law, its overall framework will be more complete than relevant policies.
